Nowadays the evaluation of objects of intellectual property and intangible assets are carried out in accordance with regulatory framework, approved by the Republic of Moldova Government. The set of regulatory documents includes: Law on evaluation activity, No. 989-XV dated 18.04.2002; Regulations on evaluation of objects of intellectual property, No. 783 dated 06.30.2003; Instructional guidelines on evaluation of objects of intellectual property (attachment to the current Regulation); International Evaluation Standards, approved by the International Committee for Standardization of Evaluation in 2005 (VIIth edition); “Accounting of intangible assets” 13 National Standards, approved by the Order of the Ministry of Finance of the Republic of Moldova, No. 16 dated January 19, 1999.
Creation of these documents was a longstanding process, since 1997.Within AGEPI, by the initiative of its first General Director Mr. Stashkov, we elaborated instructional recommendations on evaluation of objects of industrial property. They included detailed description of the entire procedure of evaluation of all objects (inventions, trade marks, etc.), description of methods, directions and purposes of commercial usage of intellectual property, applied in accordance with the International Standards, and other necessary moments. These Recommendations were harmonized in established order by the Ministries of the Republic of Moldova Government. These documents maintain confidentiality of their creation and registration of author’s rights. We also participated in elaboration of the Law on evaluation activity, in pursuance of which the Government approved the above-mentioned set of regulatory documents that are the main methodological basis of evaluation. This set of documents represents shorter variant of the Instructions Recommendations. The approved regulatory framework represents detailed description of evaluation process in this field unlike the CIS documents, which was overscored at the international conferences. Thus, after the Law on evaluation was put into force, evaluation services in the field of intellectual property obtained a real regulatory and legal framework.
The independent evaluators of the Republic of Moldova have the right to apply not only the above-mentioned methods, but also those published in the open press. It should be mentioned that the Republic of Moldova within the AGEPI has a huge experience of evaluation of intellectual property. Within 1998-2009 more than 80 objects of intellectual property were evaluated, including softwere products. Besides, the elevation services market includes the system of independent evaluators, the evaluation reports of which have to be approved by administrations of the enterprises, where evaluation of market price or initial cost of objects creation was realized. Nowadays within the SE “CRIS “Registru” evaluation of softwere products, created by its employees, is carried out. This is a necessary activity, as information systems represent important final products, basis of production activity and basis for services rendering by the enterprise. Many of them are of commercial value and may be an additional source of income. That is why this intellectual property along with tangible property should be taken into account in the balance of intangible assets. This may be a starting point for further commercial use of software products.
